No delivery received

Today is the second time I have been ****** by an Uber eats driver and Uber eats do not protect their customers at all. The driver took a picture of my goods in his bag and marked as delivered so I cannot get a refund. When I called him he confirmed that he has my stuff and can bring it to me at an extra cost and it was in fact not delivered
