Driver taking food back after claiming that he left it behind

I have never had a problem with uber eats until recently. I placed an order and gave clear instructions of where the delivery person should come and bring my food. Upon arrival, he decided to stay with my food at the reception area, without calling me to let me know he has arrived. The app kept saying that he is 1 minute away. I tried calling him and his number went to voice-mail.

He finally decided to leave, took a picture of the food and claimed that he left it at reception, but i have CCTV footage showing that he left with my food, and uber refuses to refund me, claiming that the driver waited for too long and is not their responsibility what happened to the food after it has been delivered or "left behind" rather.
