Delivery guy stole the order

Placed a order on Saturday. App says driver picked it up and then got a notification to say delivered. But food not received. Tried contacting the driver no answer. Then reported it to Uber which they refunded me but charged me for delivery and service which I never received. This is absolutely ridiculous that a driver can just ***** your order anytime they choose and we still get charged a fee.
