Bad service

I ordered food from Kauai via UberEats and I missed the call from the driver, I tried calling the driver back in 3 minutes after the missed call but no answer and he left a message saying he left my food at the main gate which is not true. I queried on the app and they are saying I can't be refunded because the driver followed their policy,,and **** saying he waited more than 8 minutes.
