Update on ******* charges for refund. Travelstart caught lying about airline policy. By law, im entitled to a refund

<p>Good day</p> <p><br />I have contacted Travelstart and requested a cancellation and refund on 4 tickets booked to Istanbul departing 7th August. Was told I'd be charged exorbitant cancellation fees which is absolutely *******!</p> <p><br />Here are the 2 Turkish Airlines reference numbers for the 4 tickets booked through Travelstart's Nextgen:</p> <p>1) U7TPUY</p> <p>2) UYHXLE</p> <p><br />Due to the current political unrest in Turkey we are forced to cancel all 4 tickets. I have personally made sure that i have taken out the cancellation policy upon booking all 4 tickets and was charged accordingly.</p> <p> </p> <p><br />I have been doing some research and realised that Travelstart has ****** people before by lying and refusing to give refunds, also delaying in doing so and not ever giving full refunds when due. </p> <p><br />(Open link for similar case)<br />http://www.iol.co.za/business/personal-finance/no-fly-zone- ********** </p> <p><br />Hence i have been in touch with my lawyers and will be polite for now in requesting my full refund as a "customer" of Travelstart.</p> <p> </p> <p><br />The claim that international companies are not bound by the CPA is a common one, but it is inaccurate when they provide goods or services in South Africa. An agent or broker such as Travelstart cannot “delegate” its obligation to comply with the CPA onto the principal – it must refund the customer in full and then claim a refund from the airline. Both the agent and principal must comply fully or they face penalties.</p> <p><br />I am entitled to report Travelstart to the National Consumer Commission, which could impose a fine of up to 10 percent of the company’s annual turnover or R1 million, whichever was higher.</p> <p> </p> <p>I was charged for cancellation policies on all 4 of the tickets purchased and hence demand a FULL REFUND! Non negotiable. Travelstart has refused to give us full refunds. We were offered a refund on the R289 cancellation policy we were charged for per ticket, as a token of "Goodwill", not sure how that makes any sense.I was also told that the Airline charges a cancellation fee and thats why Travelstart has to charge ridiculous cancellation fees which is absolute hogwash!</p> <p> </p> <p>Here is Turkish Airlines Refund policy:." Voluntary Refunds<br />If the passenger wishes a refund of his or her ticket for reasons other than those set out in Paragraph of this Article the amount of the refund shall be:</p> <p>if no portion of the ticket has been used, an amount equal to the fare paid, less any applicable service charges or cancellation fees;"</p> <p> </p> <p>We paid full cancelation fees upon booking the tickets, hence that R289 is the only amount that perhaps won't be refundable. Everything else is fully refundable by law.</p> <p><br /> I will most definitely take this up with the relevant authorities as well as my lawyers and the media if my refunds are not processed immediately. I refuse to be **********. Travelstart has already tried the same tricks before and succeeded often enough with this *****ery, but not with me and not for much longer.</p> <p><br /> So refund me fully immediately or i will make every effort to make sure this *****ery makes Travelstarts clients aware of their hidden agendas.<br /> I have my rights as a consumer, and i will get whats due to me at whatever cost!</p> <p><br /> Awaiting your response as this is just starting to get really interesting.</p> <p><br /> Kindest Regards</p> <p>Mohamed Suliman</p>
