Vehicle Purchase

I traded my Nissan Micra in for a Mini Cooper Coupe (SX32) from Southern Toyota. When we bought the car we asked if the car was mechanically in 100% good working order and if there was a service record on the vehicle. It was important to us to know who the previous owner off the car was, because you cannot buy certain vehicles from certain owners, for Example, You do not buy a fast small car from a younger person, a LDV from a farmer or Mining Company and so forth, because that will confirm the state off the vehicle. The only reason I was doing this deal, was to start building a credit record as for I did not have one and my Nissan was paid for in full. It was important to me and my husband that the car that we are buying is in a 100% good mechanical working order, because I travel a lot off long distances alone, and that this vehicle was not in a accident. The Nissan Micra had a full service history and mechanically in a 100% working order, I could get in the Micra and travel to Cape Town with - No Worries. It was confirmed by the Sales Person (Jan) on more than one occasion that the car is in 100% working order, that the Mini Cooper does have a full service record and that he pulled reports from all the insurance companies and all the records on this Mini Coopers Vin Nr and that the Mini was Never in a car accident. (Don’t even know if this is possible?) Jan also said that the sale was done so quickly that he himself did not have time To drive the car and that I should drive the car and phone him if we had any problems… His service was very good and promising at the time Off the sale. These were the faults on the Mini that was reported: Faults on Mini Cooper • Windows has serious wind noises – Maybe the rubbers must be replaced or the windows must be programmed to close more tightly? • Rattles in car • Radio Bluetooth password • Radio back button gets stuck (last button on right side) • Dust inside the speedometer meter (don’t know if we can get it out?) • Engine makes serious sounds when you start the engine, even when hot (Sounds just like a tractor) • Whilst driving, when you drive slowly sometimes the engine is silent and then when it goes over let’s say ±1000rpm it makes the same noise and when you go over let’s say ±2000rpm it goes silent again? – Maybe if the car is checked / Serviced / put on machine it will show the problem? • The cover on the inside off the bonnet is missing • The wheel alignment / balancing must be done, it has an effect on the steering wheel. • The passenger door does struggles to open from the outside. • Every time the car is switched on, the car makes a sound, like something is connecting or I should be aware off something – not sure if you can assist with it. • Every time the car is switched on, there is warning lights on the dash, because I don’t have the Manual I don’t know what it is and what should be done. There is also an exclamation sign that is permanently on, don’t know what is wrong. – If you could just double check if it is nothing serious. • The car needs to go for a vale, there is dark marks on the roof • When the unlock button on remote is pressed in for a while the windows opens automatically but when you do it with the lock button it does not close the windows automatically. • Sometimes the car does not want to lock, then you have to press the unlock button and then the lock button again for it to lock – can it be the battery maybe? • The lights must be adjusted, I tried to use the button as shown but it is still not aligned. • The cigarette lighter “thingy” is missing • I received a holder that you put in the cup holder, but it does not fit or click in? Is this maybe because it is not supposed to come with the car? • I also need the spare key • I also need the manual • Please don’t forget to send me back my nr plate. This Report With the proof off Payment for the registration that I had to do, was send to Jan. (Jan said that they could not do the registration because off the difference in Provence?) I also phoned Jan and confirmed that there was “Over Spray” on the inside off the doors, but again he assured me that this vehicle was NEVER in a accident. The Car was collected from me, on 08.08.2017, for these issues to be addressed to. I received my car back on 19.08.2017. I noticed that only the issues marked in Blue (above) was addressed to. On Monday 21.08.2017 we took the Mini to BMW, the Technician that assisted us, showed us were the problems was for the wind sounds that where hearing, when he got in the car, he said that the one tire was flat and that the car must be serviced. When he switched the engine on he could hear that there was something wrong with the engine and that the engine is “missing”.. He then took the car to the Diagnostics Machine were we received a list off faults in the engine, car and sensors. (see attached document), we also noted that the car was last serviced in June 2016 on 51 000km’s and the Mini Cooper had 70 000km on the clock when we bought the vehicle. We then took the curtesy to book the Mini in for all off these issues to be addressed to, the appointment was made at Melrose Arch Auto for 15.09.2017 with Reff WIP58376. When we spoke to Jan at the dealership, and we did send the report to him, he then confirmed telephonically that they will come and fetch my car with a trailer, lock it up at the dealership and take it to Melrose Arch on 15.09.2017, to be fixed, we can then meet him at Melrose Arch if needed, but I did not trust the dealer anymore as for everything that was told to us, by the dealer was not true. Jan then wanted to take the car to GP Motor Works, who also has a bad rating, this Garage was not Registered with BMW, I demanded that the Mini Cooper S was taken to a proper BMW dealer that specialises in Mini’s, after numerous calls Southern Toyota agreed to Book the Mini in at Melrose Arch. Southern Toyota insisted telephonically to come and to fetch the Mini, because they said that they were scared that the Mini will breakdown if travelled the long distance. They send a driver with a trailer to collect the Mini on 06.09.2017 at about 17:00. When loading the mini the right hand ramp disconnected from the trailer and the Mini dropped down on its chassis. When the driver realised that something happened, he slammed the door when opening it, against the side of the trailer, he had to climb over to the passenger door to get out, leaving shoe marks all over the inside off the vehicle. My husband had to assist the drivers to lift the Mini, just to get it back on the trailer. When we contacted the dealership the next morning, the dealerships response was: “We are not a towing service and cannot be held liable for it”…. then why insist fetching the vehicle and not make use of competent people? On confirming with Melrose Arch on Thursday, if they did receive the Mini they said that Southern Toyota’s Electricity was off and that they could not open the gate where the Mini was parked, but when we phoned them, Jan said that they put the Mini on a Lift first to see if there are any damaged caused by the accident that happened the previous day, we then asked him how did he manage to put the Mini on a lift if there is no electricity and that he need to take the mini to Melrose Arch a.s.a.p. as for I do not TRUST Southern Toyota and do not want my vehicle on their premises. The mini was only Delivered to Melrose Arch the Thursday Afternoon. We collected the Mini On 26.09.2017, After but no payment for the repairs was made to melrose Arch and we live in Ellisras. Because I cannot go without a vehicle any longer we paid for the repairs of the Mini, we contacted Jan telephonically and he confirmed that they will pay me back my money. When we drove home I noticed that the wheel alignment was not done and took the vehicle to Tiger Wheel and Tire, when doing the balancing it was brought under our attention that 3 out of the 4 rims was damaged and needed to be replaced, we then replaced the rims, and when the Wheel alignment was to be done, they had to fix the Castor / Cradle Shift. Everything that the Dealer told us about the Mini was a lie from the start, and even when they had the mini for the first time, they did nothing to fix or resolve any off the issues that was listed. If you look at all the damages on this vehicle, it is safe to say that this vehicle was in an accident off some kind. I compiled a report off the money that is owed to me and I did forward it to Southern Toyota, but I haven’t received any payment off any kind, not even the Registration money, every time that you mention the word money they only respond with: “It was send to our payment department”.
