faulty toyota vechicel

I'm currently experiencing a problem with Toyota customer care on the after sales side of things. the problem is that the (Toyota quantum(56d)) vehicle has a break shudder from the day i began using it however Toyota did do some repair but this did not help as the problem keeps on returning as of today Mr Kegan the service manger from my Durban south Toyota keep on fighting with me that the vehicle is been abused and warranty will no longer be paying for the repairs (my other older model is now doing 245000 km and still does not do this)

somebody help me fight Toyota on this
