Unwilling to give refund or credit during KZN floods in Amanzimtoti

We booked a holiday using Booking.com at Illovo Beach Club from 15-19 April (Easter weekend). Due to the severe flooding in Amanzimtoti, I requested the booking to be cancelled or alternatively a credit given to visit at another time. I phoned Beekman Holidays who manages this resort and spoke to a consultant who informed me to email my request. I then proceeded to phone them the next day to follow up on my query, only to be informed that their cancellation policy does not include "acts of God" and therefore I will be liable for the full amount should I not go to the resort which is R7150. When I asked the person on the phone if she would go to Amanzimtoti during this time, she rep**** that she would not. According to the Consumer Protection Act I have a right to cancel a reservation with "Depending on the nature and circumstances, suppliers are entitled to request a reasonable charge for the cancellation". I do not feel that charging the full amount is reasonable at all, and they are entirely unwilling to negotiate on this. They expect either that I go to the resort, potentially putting my family at risk, or pay the full amount.

Dear Marcelle

We sincerely apologise for the inconvenience brought about by the recent unprecedented KZN floods.

The safety and comfort of our guests has always been our priority and will continue to be. Please note that during such unforeseen circumstances, we as a company also had no choice but to deal with the matter on a day to day basis, with guidance and advice from our local municipalities and trusted news providers.

We can confirm that at the time of the rains, our resorts were operational and accessible, as its structural integrity has been braced for adverse conditions over the years. In terms of water restrictions as a result of the floods, back-up water tanks, reserve water supplies and boreholes at a majority of our resorts helped curb this issue. Although inundated with calls from concerned guests, we are happy to confirm that we were able to attend to their queries and assist each individual matter in a reasonable manner.

It is our aim to provide our guests with a memorable holiday experience and are glad to have done so despite these unfortunate and trying conditions.

Kind Regards
The Beekman Group
