Misrepresentation
<p> </p> <p> </p> <p>My Ref: Contract no.0341</p> <p> </p> <p> </p> <p> </p> <p> </p> <p> </p> <p>Good afternoon.</p> <p> </p> <p> </p> <p> </p> <p>On the 20th of August 2016 my wife Paulina Motlhabane and myself Wilson Lesola Motlhabane purchased a time share in respect of San Martinho in Mozambique, for the value of R67 000,00.</p> <p> </p> <p>We were helped by the sales lady with the name Marie at the place near Sun city.</p> <p> </p> <p> </p> <p> </p> <p>We bought the holiday ownership in at the above Beach club because we liked it and it was very convenient for our family as it had three bed rooms and was also on a special price. The sales lady (Marie) explained to us that as long as we can pay the deposit of R2000.00 and the monthly instalment of R1 628.35, which was to commence on the</p> <p> </p> <p>31st of October 2016, the San Martinho Beach club would be available for us by October 2017. We were thrilled to here that as it has been our dream to spend holiday as a family in Mozambique. Marie even advised us that it was wise to make a booking earlier as soon as January 2017 after settling the annual levy fee.</p> <p> </p> <p> </p> <p> </p> <p>As agreed we started honouring our monthly obligation of R1 628.35 from the 31st of October 2016 to date until we contacted your company earlier this year to make a booking for the 6th -13th October this year.</p> <p> </p> <p> </p> <p> </p> <p>To our surprise our booking was declined as it was alleged that the place was not going to be available for us as that could be during pick season, and therefore we were not qualifying. We also for first time heard that unless we pay a prescribed amount 48 hours prior to occupation of such alternative one roomed holiday apartment, other than the one we bought, it was no going to be possible for us to go to San Martinho.</p> <p> </p> <p> </p> <p> </p> <p>It was so frustrating as we for first time heard about us only qualifying for ‘flexy weekends”or option to upgrade by the amount exceeding our present monthly instalment or skipping one year without going to holiday in order to accumulate enough points or settling for weekend holidays. </p> <p> </p> <p> </p> <p> </p> <p>We made it clear to Marie that we as a family prefer to go on holiday together and therefore need a bigger house, and also indicated to her when we would like to go yearly. Nothing regarding the above was said to us when the contract was concluded, including the issue about the points. She told us that her company was not using the point system in order for the client to qualify for holidays in specific places but all of a sudden we had to accumulate certain number of points to be able to qualify for some holidays in certain places.</p> <p> </p> <p> </p> <p> </p> <p>As for the agreement, there seem to be a lot of undisclosed information which only unfolds now that we want to make holiday booking.</p> <p> </p> <p> </p> <p> </p> <p>To be honest I am very disappointed and feeling betrayed.
