Retrenchment Claim Rejected

To whom it may concern,

I have taken account and retrenchment protection plans for the above mentioned account numbers, commencing in July 2018. I went onto maternity leave effective 31 August 2018 and in maternity leave, my employer notified me of my retrenchment, that will be effective 31st of December 2018. In January 2019 I completed and submitted TFG Retrenchment Plan Claim form, to make use of the benefits of the account and retrenchment protection plans for the above mentioned account numbers. My documentation was assessed and then the claim was rejected due to: WAITING PERIOD IS THREE MONTHS COMMENCING FROM THE INCEPTION DATE / UI 19 Termination Date (31/08/2018 as per DoL).

Keenan Williams (TFG Assessor) informed me that this claim was rejected due to the above mentioned reason. The UI 19 submitted to TFG was 31st of December 2018 and upon verification with Department of Labour (DoL) it stated that my retrenchment was 31st of August 2018 (Maternity leave date). On Monday, 29 January 2019 I was at DoL Goodwood (for my personal UIF Claim) and to update the UI 19 Form to 31st of December 2018 for TFG Claim. The UIF Officer advised me, that the UI 19 form cannot be amended to 31st of December 2018 for retrenchment, the DoL will reject the claim because I have not been contributing to the fund during the maternity leave although I have been retrenched effective 31st of December 2018 (See company documents attached). Should DoL enter the 31st of December 2018 onto their system, DoL will then make me liable to pay for four months (maternity leave). The UIF officer also advised me that my ex employer/company provide a letter to explain the situation instead (See Attached). I therefore appeal that this two claims be reassessed and reviewed. Please advise what we do in this situation and who I communicate with to resolve this issue. Please find urgency in this matter.
