Phone repair not covered under warranty

I purchased a cell phone from HI DIRECT in April 2015, in April 2016 is ent it in for repairs, knowing the repair is fully covered under warranty as the only problem we encountered with teh phone was that it was switching off,

about two weeks after sending the phone in i received an sms from mTN requested an amount of R330.00 to be deposited into there account for a handling charge/fee for the phone, on calling the head office they notififed me that the phone repair was an out of warranty repair as teh track pad was malfunctioning.

firstly when i sent the cell in for repairs the track pad was fully functional

secondly i was not informed of R330.00 charge neither did i sign a consent of sending the Phone in under the terms set out by MTN Repair cetre as i was not made aware of these terms,

the lady at Foschini said they MIGHT be a fee but MTN will call me before proceeding repairs.

now i have a bill of R330.00 for a cellphone which iis covered under warranty and i am liable to pay this for a trackpad that was broken after sending it in to the service centr?

we hve called MTN and according to tem the matter has to be taken up with TFG group,

this is ridiculous for customer service, as well as there has been so many different hands and departsments handling this repair, who is teh responsible party that you need to speak to?

this information should be availabe to a client on purchasing a cellphone, as the sale is always good enough but teh customer service after is despicable.
