Locker Phone

I was at local pub and my phone was in my zipped trouser pocket, there was a time I was reaching for my card as I kept my card and phone in the same pocket when I realised the pocket was unzipped and both the phone and card were ******. I then launched a claim with techsured my claim was declined reason being "I should have kept the phone in a locked place, if not in use" how does one keep a phone in a locked place as one is always getting calls and I was going to use it to call a cab from where I was to home. I felt these people always avoid paying out claim because even the reasoning does even make sense, if it were a laptop it would make sense whoever goes somewhere and keep their phone in a locked place how do you then make calls or text?
