Unresolved Issue with Defective iPhone 14 Pro Max and Lack of Response

I purchased an iPhone 14 Pro Max from Takealot on 30 June 2024, trusting I was buying a brand-new product. However, after a minor fall on 5 November 2024, the phone became non-functional, despite being in its protective cover, which was also purchased from Takealot. An assessment by iStore repair Centre revealed the device had been tampered with by an unauthorised third party and had missing *****s and ***lings—indicating that I was sold a phone that was not new, contrary to Takealot's adverti*****t.

I reported the issue to Takealot on 15 November 2024, requesting a refund under the Consumer Protection Act. Despite following up, I have yet to receive any response or resolution.

As a long-standing customer, I am deeply disappointed by the lack of transparency and poor customer service. Spending a significant amount of my savings on a defective product is unacceptable.

I kindly request urgent attention to this matter and a resolution to restore my trust in Takealot.

The only response I received was: 'We, unfortunately, cannot make an exception or accommodate this return as it sets a precedent for returns outside of the return policy.' This response completely disregards the fact that I was sold a product that was not new, regardless of the fall or damage to the phone. I feel that my consumer rights have been violated by Takealot. How can I just let go of R27,999 for a defective product.
