TAKEALOT not returning goods.

I bout a kids tablet, got damaged in less than 3 months, sent it back to TAKEALOT as it was under warranty, they said they won't fix it, I have been waiting, calling and sending emails for over a month for it to get returned and I have not received it back. Should I open a case of theft against TAKEALOT then?
