TAKEALOT GIVES A LITTLE, LESS THAN ADVERTISED

I bought a Samsung 43” Smart TV at TAKEALOT in Dec 2019.

FACTS Let me say that I have 3 other Samsung TV’s 40 “ and My Friend bought a Samsung 43” Smart TV 2 years ago. This TV plays all formats.

TAKEALOT advertised a Samsung Smart TV 43” which I bought. I realized that this TV does not play AVI’s even the ones that play on my 40” Samsung which is not a Smart TV. I contacted the help-desk or customer service center and those people don’t know how to explain to me that this TV that I purchased does not play a AVI format file. They started by saying the wires at the back and I quickly explained that I am referring to the format of the video or movie file. Then some person on the customer care said that they had to change and make place for other formats and that it doesn’t work I need to convert it. Later... I was told a similar story by Hermany Cardozo in an email

When the country reached level 3 of lockdown I contacted TAKEALOT and returned the item ..RRN-04c1-13c8) (***). The person there told me that it plays all the formats, all I have to do is to convert the AVI to ….. (this is where I don’t listen anymore)… I left the TV at TAKEALOT for a while and they insist that there is nothing wrong with the TV. And I explained that I have a 2 TB external with 1000’s of AVi’s. Movies and Series and if I knew it will not Play the AVI like my other Samsung TV’s then I would not have bought it. I was told to pick up my TV or give an Address so it can be delivered.

ISSUES 1. The Samsung 43” Smart TV is advertise by TAKEALOT as being able to play AVI’s nowhere does it state that it must be converted. 2. My previous Samsung TV’s 40” and my Friend’s 43” Smart TV plays the AVI format, it is reasonable for me to expect that it would give me the same functionality or better. 3. TAKEAOT is an online store, one can’t walk in and test the product you buy what is advertised and expect to get what is advertised at minimum what is already out in the market. 4. If hypothetically it only played MKV format can one advertised that it plays all formats and then later argue that it does play whatever format you have all you have to do is to convert it to MKV ?

WHAT ARE THE RULES I can return it if I am not happy I can return it if I bought the wrong Item I can request my money back. I can expect and demand the functionality of the item as advertised especially if it’s an online store. The store is not allowed to advertise falsely or being misleading. The consumer Protection Act Section 29 – requires the marketing of goods or services to be done in a manner that is not reasonably likely to imply a false or misleading representation concerning those goods or services and not misleading, ********** or deceptive in any way.

APPLICATION. I bought the Samsung Smart TV 43” with the understanding that it plays AVI format videos and movies. The same files play on my previously purchase Samsung products. I expected to get the same functionality from this product or better since those were 2 years ago. TAKEALOT cant be deceptive, ********** or misleading in advertising and to my mind this is what is been happening in this case.

CONCLUSION It is clear that I was sold a SAMSUNG SMART TV that is not advertised. If I knew that it does not play AVI’s I would not have purchased it. Due to the fact that it is an online store TAKEALOT’s advertising, and descriptions should be what they sell. I would like my money back or a 43” SMART TV that does play all the formats of files as advertised.
