Takealot – CPA violation: misleading product and failure to supply goods as advertised I purchased a cable from Takealot that was explicitly advertised and described as a shielded cable. The product delivered was not the item advertised. Although visually similar, it was an inferior, unshielded cable and did not meet the specifications listed at the time of purchase. Under Section 41 of the Consumer Protection Act (CPA), suppliers may not market goods in a manner that is false, misleading, or deceptive. Supplying a different product to what was advertised constitutes a clear breach of this provision. When I requested the correct item, Takealot advised that the supplier was out of stock. This explanation is inconsistent with the fact that the same product listing has remained active on Takealot’s platform since my purchase, with the price changing multiple times. Despite this, I continue to be told that stock is unavailable. In terms of Sections 55 and 56 of the CPA, consumers are entitled to receive goods that correspond with the description and quality promised. If this cannot be fulfilled, the consumer is entitled to an appropriate remedy. I am requesting: Delivery of the correct product as advertised, or A full refund with a clear written explanation addressing the inconsistency in the stock claims. Should this matter remain unresolved, I will consider escalating it to the National Consumer Commission.
