TAKEALOT ARE TAKING A LOT
It is really important for everyone to bone up on the consumer protection act. It is available for free online. Takealot consistently breaches this law with their behaviours and you need to take them to task to get a favourable outcome. This is how:
In all my recent dealings with them they refuse any return outside of their 7 day window regardless of their liability. YOU MUST ESCALATE THE ISSUE AND QUOTE THE CONSUMER PROTECTION ACT TO THEM. Make sure you follow up ALL CALLS with emails detailing the conversation. You need a "paper" trail.
They will not give me the recordings they have of my calls regardless of their obligations under the POPI act, so do not rely on that when you deal with them.
The most relevant sections are: 16(3) which gives you a 5 WORKING DAY cooling off period for any delivered goods (not 7 ordinary days as they state in their policy which messes you around during public holidays) 19(5) and 20(2) Consumer's rights with respect to delivered goods and to return goods which expands on 16(3) 55(1),(3) and (4) which states that goods must be good quality and free of defects and determines that it doesn't matter if "product failure was latent or patent" AND, MOST IMPORTANTLY THE 6 MONTH WARRANTEE GIVEN TO YOU BY THE LAW REGARDLESS OF ANY OTHER WARRANTEES OFFERED BY THE SELLER 56(2) if goods fail in six months they MUST replace, repair or refund.
We cannot rely on our country to uphold the laws regarding businesses like these. We have to fight them ourselves.
