Selling second hand products as brand new

Purchased a new Fuji XF 27mm lens on 22 June. Received on 30 June. This is clearly a second hand lens. The box did not have manufacturers seal, it showed evidence of being opened previously and lens clothe was missing. The wrappings was old and wrinkled. Are they selling second hand stuff in the hope that unsuspecting buyers will not notice. I purchased this as a gift. I have to have replacement urgently
