Opened and damaged paint tin that was delivered this way doesn’t qualify for a refund?

I received a paint tin that was leaking when it was still in the box. We opened the paint tin and there was paint everywhere. The tin was empty. I sent back the damaged tin and box and I received a mail saying that my product doesn’t qualify for a refund! I have photographic evidence! The driver even pointed out the leak!l
