Legal action agaist Takealot.com

I have purchased a product that was Defective. Response was only that there is visible damage which is not true and they will not honour a return. This is leading me to seek justice in court. Is there someone here who have followed this route as the Clerk of The Court in Port Elizabeth has to issue a summons to Takealot to appear in court in Port Elizabeth. Do they have a legal department?
