Incorrect product received - I wanted specifically wanted correct product but instead received credit
In mid August 2018, I had ordered a Kingston 8gb ddr3 1333mhz ram for R999 which Takealot advertised on behalf of a third party. The order was delivered on time. However, I did not open the package until last week as a family member was ill and eventually hospitalised from the initial receipt of the product.
To my dismay, I had received an Adata 8gb ram (incorrect brand) but further to this , the specification of this ram was incompatible (incorrect) with my pc. I notified Takealot of this gross error and clearly stated that I want the correct product and NOT a refund.
Takealot instead had taken the liberty of crediting me as they stated that the item was no longer in stock . They have appeared to have done so also because the price of the product has gone up by R200 upwards. This is in violation of the CPA, as it is my right as a consumer to choose for a replacement, refund or repair, and Takealot cannot waive my legal right.
They currently have my correct ram/product in stock with various third party advertisers. I think it is only fair that Takealot sends me the correct product at R999 as the offer to purchase was a binding agreement by Takealot and myself, and not myself and their third party. I have emailed them an email to the above effect an am still awaiting a response.
