Hisense TV with a cracked screen

We bought a Hisense TV in January this year as a gift to our children. When the time comes to give it to the children which was a month later, the TV had a cracked screen. We contacted Takealot immediately to inform them about the problem. The TV was taken back to them. In two days they called to say it was not their fault that the screen cracked and that they are not willing to repair or replace the TV because it was returned after 7 days as per their policy. It was also alleged that the range of our TV there are no screens for them. We asked Takealot if their policy was in line with the consumer act. They said it was. We told Takealot that according to act we can return defective goods within 6 moths not 7 days. We also requested a signed document that shows that we agreed to their policy. It took days before they responded to say that as you make a purchase online you automatically agree to their. We asked Takealot how are they that we received the TV in good since the courier guy never opened the packaging in order for us to satisfy ourselves that the yes the TV was in good condition. Takealot referred us to the ombudsman. We spoke to the ombudsman who promised to come back to us with a response. It's over 3 moths now waiting for response. At one point Takealot referred us to ,Hisense but Hisense is the manufacturer not the seller. We bought our TV from Takealot not Hisense. We still have all the correspondences which we were communicating with Takealot with. The question we asked was how come Takealot sells something that cannot be repaired and the information is not communicated with the client. We asked about the warranty of the TV which they said it does not work in this situation. At some point we requested them to order the screen for us at our cost. We were told that we can fit the screen but it won't be covered by the warranty. We don't think Takealot is being fair we us even when we want to meet them half way they are still reluctant to help.
