False advertising

<p>I bought and paid for an order on Takealot on the 30/11 and received my confirmation of order. Two days later (02/12) I get an email from Takealot saying that one of the items that I had ordered is out of stock and they have cancelled that item and credited my account. I rep**** that I was willing to wait until they were restocked but their response to that was extremely unhelpful and just repeated that they were out of stock. </p> <p>The response from Takealot is unacceptable, especially as I checked and saw that the product was still being advertised on their website at the same price and as available despite being "out of stock" as was claimed. I feel that Takealot should make a better plan to rectify the situation as they took payment for an item that they knew was out of stock which is clearly false advertising.</p> <p>According to the CPA:"29. A producer, importer, distributor, retailer or service provider must not market any goods or services—(a) in a manner that is reasonably likely to imply a false or misleading representation concerning those goods or services, (b) in a manner that is misleading, ********** or deceptive in any way, includingin respect of—(i) the nature, properties, advantages or uses of the goods or services;(ii) the manner in or conditions on which those goods or services may besupp****;(iii) the price at which the goods may be supp****, or the existence of, orrelationship of the price to, any previous price or competitor’s price forcomparable or similar goods or services;(iv) the sponsoring of any event; or(v) any other material aspect of the goods or services.</p> <p>I sent this info to them and their response to that was just to update the availablity of the item on the website, even though they were in breach of the CPA.</p> <p>Takealot should make a plan to supply me with the product as advertised within a reasonable period of time OR guarantee that I will be charged the same sale price at such time that the product does become available again.</p>
