Defective TV – Refund Issued Without Consent Causing Financial Loss

I purchased a 75” Hisense Q7Q TV from Takealot, which developed an inherent display defect shortly after delivery. Takealot acknowledged the defect and collected the TV for return.

My original request was for a replacement. However, Takealot processed a refund without consulting me or obtaining my consent, citing that the model was out of stock. I was never asked whether I agreed to a refund instead of a replacement.

Since the refund was processed, the same model has increased significantly in price across all retailers. This has left me financially prejudiced through no fault of my own, as I am now unable to replace the TV at the same value.

I attempted to resolve this directly with Takealot through multiple escalations and proposed reasonable alternatives, including a comparable replacement or a once-off price-protection adjustment. All requests were declined based on internal policy.

I am a regular Takealot customer and a TakealotMORE subscriber, and I believe this outcome does not align with the intent of Section 56 of the Consumer Protection Act, which allows the consumer to elect repair, replacement, or refund.

All internal escalation avenues with Takealot have now been exhausted. I am seeking fair rectification, either through a comparable replacement or an equivalent value solution
