Hidden clauses and false advertising
I started a supersonic account for fibre in my residence in Oct 2020. My first invoice was sent to me on 28/10/2020.
I specifically asked if this is a month-to-month contract as I could no longer commit to a long-term contract as we were relocating. I left MWEB for this exact reason, to get out of my long-term contract. I was told by Supersonic that you only offer month-to-month billing and on their homepage of their website, you state "No contracts. Get billed on a month-to-month basis.
I then canceled the contract on 8 Dec 2020 as we were relocating and was told I have to give a month's notice and then it would be canceled, you collected the debit order, and then you confirmed that the line was canceled.
I have not heard from Supersonic, I have not received a statement, I have not received an invoice, since I canceled my line. On 21 April 2021 I received a call to say that a new tenant wanted to use the line to which I told the agent, I canceled this line in Dec 2020 so why would you need my confirmation? I was just told, "thank you, that's all we need", no mention of an outstanding invoice.
On Friday 7 May 2021, my ex-landlord informed me that the new tenants are still unable to use their fibre line. I then called Supersonic to find out why they can't use the line if I canceled my line in Dec 2020. I was then informed that I have an outstanding invoice of over R4000. I was told that this is a clause you have, "if you cancel your contract before a 24-month period" we can bill you as part of our clawback-period". The solution is I pay the invoice or you give me a payment plan.
1. I have no communication from Dec 2020 - May 2021 stating that I owe them any money. 2. I do not have a contract with you as you state "no contracts" on your site. 3. Supersonic states this is a month-to-month payment with a 30 day notice period, yet you have a 24-month agreement that you need to adhere to - that sounds like a contract to me. 4. Your terms state that the router needs to be returned - I have not received any communication on this and I still have the router.
This is false advertising as your messaging states that consumers are not bound to a contract. More than that, the customer service team are unhelpful, unapologetic and unresponsive.
I request that the fees be dropped as I don’t think it’s fair that I have received any communication about this and that you clearly state there are no contacts. I would also like a copy of all my call recordings where it is stated that any fees are outstanding, as well as all email communication ever sent to be stating the same.
