Enforcement of authority of by Corporate institutions
I know this is a petty case and I do not expect action by yourselves. However, I believe it is worthwhile to take notice of my experience. I hate it when large companies enforce their dominance and walk all over an individual with no recourse whatsoever. My experience: I was a contractual subscriber for home internet Wi-Fi service, with a company named Supersonic FTTX (Pty) Ltd. (Supplier) Due to poor service and disputes we decided to switch our internet service to another company. Their T & C 's stipulated that if the membership exceeded a specified period no installation cost will be charged which was honoured by them. Another stipulation stated that the router remained the property of the supplier and will be returned "to the supplier at the client's cost". I was happy to return the router as required and was ready to deliver it personally to their offices as I was going to be near their head office. Before I could get round to deliver the router, I received an email requesting that I have the router packed and ready for collection as they are sending a courier for the collection. No problem up to this point. The router was duly collected and, in my mind, contractual obligation was fulfilled. After some time had passed, I suddenly found an unauthorised debit order for R250.00 against my bank account. This transpired to be a fee for courier collection cost. I reversed the debit order and notified them that I will not pay the fee as I informed them that I was never "Given the option of delivery and would have delivered it by hand - at my cost - to their offices.". This debit order was repeatedly lodged against my bank account which I duly reversed. The cost for these reversal processes amounted to approximatelyR100.00. On my persistent request they eventually withdrew the debit order. Many months passed with no request for payment or other communication. A week ago, I suddenly received an SMS to state that if I do not pay the outstanding account I will be handed over for collection. (For R 250.00?) After long dialogue with them on WhatsApp wherein I pleaded my case and they categorically stated that in their T&C's it states that returns will only be collected by courier and that no personal delivery will be allowed. (No such wording in their document)
This is an extraction from their document; Customers who cancel a Supersonic Home Fixed-LTE service agreement will be liable to return the router to Supersonic at their cost upon cancellation, in a reasonable and working condition, or be charged the replacement value of the router at time of cancellation. During this conversation (Just to be funny I offered to pay them in instalments. This they declined as "Payment had to be made in full"
I believe that if we were to go to court I wil win my case but I am 84 years old and cannot be subjected to all such actions for such a small and petty debt. with the possibility of costs and effort and I therefor comp**** and paid the R250.00.
