Refuse to take damaged item

I have requested a return on an order i bought in July *** , the shoe was not worn until the day i sent my return request, i was asked to send a picture and i explained the issue, the shoe strip at the back is loose it falls all the time. obviously i did not have intentions of returning the shoe but i am now returning because it is faculty. i dont know how this declined because it is not line with consumer protection act.
