Used phone being sold to me

I bought a new Samsung Galaxy 01 on Saturday the 5th of September 2020 at sterns in bronkhorstspruit then when I get home I checked the phone only to find out there were scratches on the back and things that were written on the phone were faded as if someone was using the phone even the battery doesn't last as the new phone should. So I couldn't go back sooner but the next Saturday I went back the manager refused to exchange the phone and she told me that about scratches I found I was suppose to return the phone the next day. And I explained to her that I'm staying far and its expensive to come to town. She said I must leave my phone so they can send it to be checked it will take 6 weeks. I took my phone and left because I saw she wasn't helping but the phone was 7 days.
