Wrong advice leads to repossession of my vehicle

<p>I bought a vehicle black BMW 428i Convertible through Standard Bank about a year ago.</p> <p> </p> <p>I have recently had financial crisis and struggled to catch up on few payments.</p> <p> </p> <p>In the middle of May 2016 I received an SMS to call Samantha Gauche (SG) from Standard Bank Litigations number ********** .</p> <p>I called and she was trying to find out when I was going to pay back the arrears. On our discussion, she advised me that since I have financial challenges, I could surrender the vehicle back to Standard Bank.</p> <p> </p> <p>I was concerned with that, understanding the repossession process. She assured me that I will NOT be blacklisted by ITC and neither will I need to pay the balance if the vehicle was sold for less. </p> <p> </p> <p>That conversation must have been on the Friday of either 20 or 27/05/2016, because I remember asking her to give me the weekend to speak to my family and ask around about this decision. She agreed, on Monday I spoke to her again to verify if all she promised was still the same, she agreed that I will NOT be BLACKLISTED and won’t have to pay anything after the vehicle has been surrendered.</p> <p>I then signed the Surrender form she emailed me and returned it.</p> <p> </p> <p>By the time the vehicle was surrendered it was in arrears for about less than R15,000. It would be over R30,000 including the new monthly installment.</p> <p> </p> <p>I was clear to Samantha that I could sort out the arrears in time, but the only motivation would be to surrender it at no adverse ITC record and no need for extra payment after the car would be sold. Again I was assured that I should not worry.</p> <p> </p> <p>The vehicle was collected, and I didn’t hear anything from Standard Bank until I saw a “Repossession Default” on my ITC profile. I called her to ask why the change from her statement and she explained a lot of what I couldn’t understand and told me that my file was moved from her department. I should call Bonisiwe at ********** .</p> <p> </p> <p>Bonisiwe told me everything Samantha said to me was not true. Bonisiwe referred to you Thabiso, and I now understand that the vehicle was repossessed hence the default on ITC and yes I am also liable for about R300,000, since the vehicle was sold for less.</p> <p> </p> <p>I am extremely unhappy with this arrangement, I would not have surrendered the vehicle if I was not given the false promises by this Standard Bank official, Samantha Gauche.</p> <p> </p> <p>I would really like this matter investigated, recordings of these conversations with Samantha found, and that if my vehicle cannot be returned to me, I should not be held liable for the balance after the auction. </p>
