Unbearable series of calls from Norman Bissett because Standard Sold my Personal Loan Account which was on Debt Review

I and my husband have been on debt review for some time. From the time we went on debt review only one debtor has been calling us, selling our accounts to different Attorneys or Debt Collectors, sometimes one at a time. At one time the Attorney who is part of KZN Debt Counselling had to write a strong letter to our defence.

Our strategy is targetting one account at a time and pay separately over and above the PDA payment until we settle the account. Standard Bank was Our Bank of choice, but this changes once we were on Debt Review. As our the Bank of Choice you would understand that we had more accounts with them.

In June 2016 I contacted the Debt Review Administration for a Discounted settlement amount as we intended to pay the Personal Loan up in July 2016. After waiting for a long time I was given the settlement amount but I was told that my account had been sold to Nimble/Norman Bissett Attorneys. When I asked for the reason I was told that I did not pay for July 2016. I was asked to get evidence of payment from the PDA which I did. I sent that to the Debt Review Administration and copied other Debt Review sections. My issue was handled by Nonzwakazi Lembede. They took time locating the where abouts of the payment and told me that they found it in their suspense account, which was proof enough that I paid. Even after that they referred me to Norman Bisset Attorneys. This is their response : "Kindly be advised that I tried to get hold of you over the phone with no success , Please note that the below mentioned account ( ********** 10******B91) was sold to Nimble Attorneys on 18/07/2015,kindly be advised that we managed to trace the payments made into our suspense account ( ********** 66) and they have been allocated to Nimble as they are currently handling your account.

Please contact Nimble attorneys on 021 ********** in order to request a paid up letter and a refund, should it be due."

The payment made in July and the one made in August by the PDA plus one made by me directly meant that I had paid more that the Discounted amount and the Balance given with the discounted amount, considering that there was proof that I paid. I feel I should be refunded the overpaymnet. My then Debt Counsellor pursued this matter after correcting the Current Account one (also sold unneccessarily), but unfortunately she left. I have been pushing this matter; the new incumbent, Debt Counsellor, wrote to Nimble and had Wendy responding and promising to attend to the matter to no avail.

My husband and I get approximately seven (7) calls each (private number) from Norman Bissett per day. One lady some weeks ago was reasonable enough to listen to my story, asked that I forward all the email communication to their company email. She said the records show that my account was sold to them on 15 June. She promised, after talking to her manager, that they would do a follow-up with Standard Bank, and she asked me to tell anyone who phoned from their company that she is handling the case. I will not give her name here. Up to today Norman Bissett is calling me/us despite telling caller that. In the morning I received a call from a sensible guy who gave me an update that they are dealing with my matter. A few minutes after that a lady phoned with the same old question on when am I going to pay, after quoting "the outstanding amount" .

One must also mention that a call from a "private number" is viewed suspiciouly in our community/ society as some use it for black magic.

I request that Standard Bank attend to this matter. I need that proof of settlement of the account. We managed to pay up the Current Account in December and now have a settlement letter, whilst this is leaft hanging with us tortured by calls from their Attorneys. THIS CHAPTER NEEDS CLOSURE.

We cannot but continue with our Standard Bank Home Loan because we have no choice under the circumstances.

If it were according to me I would have reported this last year to the Credit Ombudsman, but my Debt Counsellor thought the Bank would sort it out earlier. What is worse still, we get called by attorneys directly, from year 1 of the Debt Review, and always find that our Debt Counsellors have not been informed about the step. Even i fwe give them contact details of our Debt Counsellors they keep coming back to us. And to crown it all, we have not skipped any monthly payments.
