Ucount rewards system- unimpressed

Regarding: TomTom Runner GPS Sports Watch

· Ordered this watch on the 1st February.

· There was no option to select my colour and I was automatically allocated a green and black watch which is not what I wanted.

· I was then told that they had run out of stock so I must take the green and black watch or cancel my order - I opted to take the green and black watch

· The watch arrived and I struggled to get it to work, it was not accurate and wouldn’t switch off demo mode. The GPS signal was not accurate at all.

· I called the Ucount team and a lady named Shannon helped me (she was very helpful and sweet but also wasn’t knowledge on what I needed to do to resolve the problem).

· I explained that I was not happy with the watch as the watch was not working properly and wouldn’t switch off demo mode.

· I said I wanted to return the item and she said I needed to call and get a reference number.

· She informed me to call Tom Tom in the UK and advise them of the issue.

· I called Tom Tom UK and they had no idea what I was talking about.

· I then called Shannon back and asked her to please obtain the reference number on my behalf and arrange for the item to be collected.

· The item was collected after a failed attempt as the first time they arrived without notice and I was not available.

· Shannon then called to say that they had now turned off the demo mode and the watch should be working and they will send it back to me.

· I asked if I could rather just be refunded but was advise that I am out of the returns period according to your policy.

· I have received my watch back and have again tried to use it and it is not fit for its purpose. The demo mode is still on and the GPS is not accurate.

In terms of s56 (read with s55) of the CPA, all goods sold to a consumer are sold with an imp**** warranty of quality, that cannot be contracted out of or revoked. The warranty gives the consumer the right to receive goods that are reasonably suitable for the purpose that they are intended to be used for. If goods are found not to comply with this requirement then; the consumer has the right to return the goods up to a period of 6 months. The consumer can do any of these things without penalty; and at the suppliers cost.

I would like the item to be collected (it is still in its full packaging), and my Ucount points to be refunded to me so that I can actually spend my hard earned points on something that I will find use in.

I spent months saving my Ucount points to be able to purchase this item from the online mall and it has failed. I intend on spending these points at the Online Mall with Standard bank and insist that I am given a refund on my points.

Please can I have a response to this problem asap.

Thank you

Kirsty
