Standard Trust (Durban)
In April 2017 my father passed away, he had a Will with Standard Trust which was drawn in 2006. My father was married to two wives customary in 1977 and 1979, the marriages were later registered in 1981 and 1984 as civil unions. Standard Trust was instructed in terms of the Will to transfer the properties to the wives, instead of transferring the property Roshnie Moodley who is the executor of the estate challenged the validity of the marriage to the second wife who is my mother. According to her the marriage is invalid because two civil marriages cannot co-exist. She further stated in her email that she cannot distribute the assets up until my mother assumes her ****en surname, as correct distribution is required. We have sent numerous emails to her with no response, asking why this issue was not raised in 2006 when the Will was drawn by Standard Trust. How was the Will legitimised if the second marriage was invalid? Her response was that she is consulting Standard Bank legal department (the same department that legitimised the invalid Will). She further stated that the Will was drawn by a Bank Consultant who has no legal knowledge. In other words Standard Trust is questioning their own Will and in the process inconveniencing the heirs as the distribution should have been done +365 days ago!! If a legal document was drawn by a consultant with no legal knowledge and legitimised by the Standard Bank Legal Department, doesn’t this mean that the Will is invalid? Standard Trust should therefore not be in possession of the Estate. The funds of the estate are being **********ly consumed by Standard Trust through seeking legal “expects” . Why is Standard Trust still holding on to Estate seeing that the Will is not legit? The legality of the marriage and lack thereof is not the concern of Standard Trust.
