South Africa "s worst estate Executors

SOUTH AFRICA'S WORST ESTATE EXECUTORS. We bought a house under a trust in December 2020 and we were told that our house will be registered in 3 months time. We paid a huge deposit as we didnt want to have a huge bond. The agent didn't know that it will take so much time to register. We as purchers decided to rent in the house until it is registered as we thought it will be registered within 3 months. My husband bought the house with his pension money. We send emails to the transferring attorneys and executors about our house still not being registered. The deed of sale was received on the 28th of February 2021 which we signed iin December 2020. Then we started asking questions about the registration because they said the house will be registered soon. Instead the executor told us not to contact her as we are not her client. We and our agent contacted the standardbank transferring attorney,she kept telling us she doesn't have information. The nex worst thing she then send an email in September after so many enquiries saying they are going to transfer the property to the Will trust first and then selling to us, or directly from the Estate to the Purchasers with the Court’s consent. Now in January we again enquired about the status of the house, we are told she (executor or trustee) no longer works at Standard bank.. So if one resigns, it means no one is able to give information to the status of the house. There is a lot of incompetency in this Standard bank department. Its January 2022 with no information from the transferring attorney,executor or trustees. What pains us is that we cant even cancel the deal as there is clause that says Deed of Sale provides that: “The sale is subject to endor*****t by the Laster of the High Court, of the Power to Pass Transfer in terms of section 42(2) of the Administration of Estates Act, Number 66 of 1965 (as amended) but until such endor*****t of the PURCHASER shall be bound by the terms hereof and shall not be entitled to withdraw here from.” The implication of the above mentioned provision is that we are not in a position to simply terminate and/or cancel the agreement as a result of the delay in the transfer of the property. We are held as hostages with a house that we bought .We cant renovate or do anything. The house was bought with an aim of living with our parents but this cant happen as we cant prepare a room for them. This is unfair and heartbreaking for us. The bank will be getting 5% of the money that we paid as a deposit. We are tenants instead of owning the house. How long are we going to wait for registration of the house? We dont want to loose our hefty deposit by canceling the deal and have sickly parents that we can’t look after properly.
