RCA more than double the original amount taken- interest still accruing. Irresponsible lending
I have had an RCA for more than 10 years. It was paid off at one point but they had neglected to stop the insurance. When they called me to say I was in arrears, the consultant advised me not to close the account. I informed them I was unemployed at the time, but he was adamant, it would be fine. Suffice it to say, pandemic, hard financial times are no joke. In all this time, I have made arrangements to pay a small, affordable-for-me amount. But the bank has not stopped the interest on the account which makes the total now more than 2X the original loan amount. I obviously couldn't pay the amount off , but now the loan is more than double?? According to them, it was in their contract, which they can no longer find.
Not only do I get hounded and harassed by Brooks & Luyt attorneys at all hours of day and night, but I've asked for a statement of all the monies that I've paid in over the years, those lumpsums that I've thrown in when I could- Nothing! Curiously, Brooks & Luty insist they've only handled this account for the last 2 years or so and have no records. And the Bank, well, the Bank says I must pay R40 per page of my statement AND they refer me back to the harassers.
Is there a law or legal precedent that allows banks to continue to charge interest to the point where the amount owing is more than 2X (double) of actual loan amount??? Isn't there a set limit that it can't go beyond? Doesnt the interest stop accruing if there is an obvious problem? Even when the payee has been in contact with the bank to explain their situation numerous times? Isn't this irresponsible of a financial institution and is this responsible lending practices?
How will the average person be able to settle this or is this the point?
