Narcistic Gaslighters

Our company has been using Standard Bank, as our primary bank, and it should be noted that, more than fifty million rand, has passed through this account. Furthermore, it should be noted that COVID 19 came unexpectedly and affected most businesses and even our has been affected. Nonetheless, due to the fact that we has existing purchase orders, from Transnet Freight Rail, we have been able to ride this tide. We have signed a lot of suretyships, with Standard Bank, on the premise that, as a when we require a temporal facility or honouring our debit orders due cashflow constraints, there would be no problems. A point should be made that, we have never defaulted on our obligations with Standard Bank, when such assistance is requested. Last year in November, we app**** for an overdraft facility of approximately Two Million and Three Hundred Thousand Rand, in order to fulfil an emergency requirement. The emergency was a derailment of Transnet Freight Rail wagons, transporting manganese to the Port of Port Elizabeth for export. Consequently, a portion of half of our required assistance was disbursed, and we as Directors of the company were also working on this emergency hands on. It should be noted that, a second portion would be disbursed as soon as we signed more additional facilities. We finished with the emergency work, with using only the first portion and undoubtedly, our assistant upon receiving by email a contract to be signed last year for the second portion advised that, the Directors were working on sites and unreachable. Nonetheless, we were fortunate by being able to optimally use the resources we had on hand and to us the matter of requiring the second portion became moot. Approximately three weeks ago, we approached Standard Bank, and advised them that there have been wash- away of railway lines due to the recent flooding in Cathcart, and this has created an emergency for the East London line. As a result, Transnet Freight Rail, would be sending rail wagons to load material to rebuild that line, from our business. Thus requested a temporal facility of two hundred and fifty thousand Rand, in order to cater for the operational costs. Furthermore, we requested that our monthly debit orders for March to be allowed and honoured, whilst we are using all our resources in order to meet this emergency requirement.

I was dumfounded yesterday: a) to see a return debit of an account as unpaid b) to learn that, our application was declined, and the reason given by "Credit is that, i. due to the fact that we did not sign the contract to obtain the second portion for the November / December derailment emergency. ii. Furthermore, it is alleged that, our company at the beginning of this year stated that, "Standard Bank was asking too much from us." This is a blatant untruth because there is no such correspondence, and fortunately we communicate such issues by email, and whoever stated such remarks, misrepresented our company. Quite frankly, the contract was to be signed in order to obtain the second portion, and in January this year, there was not need of the funds, and indeed we paid our obligations to Standard Bank. Today, I have noted that all our debit orders that were allowed have been disallowed and with a reference to ÄCB Dispute. I later googled this term, and the information provided is, when a debit order is disputed by the client, and it also affects the clients bank rating.

This to me after all made me to question my own perceptions by Standard Bank presenting a false narrative, which isn’t really what corporates should be doing. This is in fact a form of a narcissistic behaviour, which is "Narcistic gaslighting". To me as a diagnosed sufferer of depression and anxiety this has heighted by conditions. Nonetheless, perhaps Standard Bank has concluded and decided that, we are no longer of use as their clients. We will grow as business, if it means not with Standard Bank as our partners, but we will grow.

My previous post has reference. It should be noted that it was posted on 08 March 2022, and was responded to in this platform almost 2 months later.

The fact that we were refused, a facility based on "Standard Bank was asking too much from us, " based on a blatant untruth whoever stated such remarks, misrepresented our company.

Subsequently this led to us losing out on millions in revenue becuase we could not perform the task at hand, and due to cash flow.

Nonetheless, it should noted that, we are at this stage being handed over to legal firms, even though we have never received any letter from STD Bank in terms of the National Cerdit Act.

It is worth mentioning that, our banker is aware of the fact that:
1. The floods damages have made Transnet, our client who we have existing purchase orders of just under R10m to priotise those areas, because of urgent national interest.
2. There are work packages that are being directed to us, but due to administrative issues (focus and priority towards the KZN flood damages), it has turned out to be a long drawn process.
3. Upon receiving this demand letters on 13 May 2022, on all our accounts with STD Bank, we were left flabagasted, and notified him to that regard.
4. A work order directed towards us is imminent and expected within 7 - 14 days, and we should be able to settle any outstanding issues due, and be in good standing.
5. No letter from Standard Bank to remedy our accounts, was ever sent and received by us.
We are really feeling that Standard Bank wants to make an example of us, even though we had never defaulted in any of our accounts, and that only transpired after we were refused a temporary facility as previously mentioned.

Thank you for the response, and all have been noted.

What is troubling is the fact that we tried to purchase fuel from our cheque account, to make deliveries to a customer, and the transaction failed. Upon further investigation on the STD Bank app, when trying to make an EFT, there is "from account stop all activity".

Previously, it was " Technical error - 2009,". We googled this error and found out it means, that the account has been placed on hold.

What is troubling, is that there has not been any communication from Standard Bank to inform us of these measures. The cheque account is our primary trading account, and we are expected to trade in order to settle our obligations with Standard bank.

Really, we are lost for words. Are being treated like the Guptas, at least they were informed

National Treasury issued a circular after the February 2022 Constitutional Court ruling for tenders from that point to be held in abeyance, bringing the issuing of tenders to a halt in some organs of state. Transnet said the Constitutional Court's silence on the timing effect of the invalidity of the regulations created legal uncer*****y in the public procurement environment.The statement said the situation was anticipated to be short-term, pending either the new regulations or clarification of the Constitutional Court judgment. Our company is involved in the construction industry and started as middlemen buying and selling crushed stoned, used in the building, roads maintenance and railway infrastructure. The construction industry Post-Covid recovery has been slow due to the government's slow pace to roll out key infrastructure projects. According to the Moneyweb article published on 03 March 2020, At least R16 billion in SA National Roads Agency (Sanral) tenders have been adjudicated but not awarded. An analyst estimates that the total value of delayed Sanral contracts could be as high as R25 billion. Further evidence has also been provided by JSE-listed South African construction companies about the slow rollout of infrastructure projects. Sanral delays awarding tenders worth at least R16bn.

This is hard felt by listed companies like Raubex amongst others. Who are we, the SMMEs, who is supposed to be a catalyst for development and employment, if listed companies are highly affected?

We have kept throughout the pandemic, including the waves which impacted our operations, including our clients. We have kept an average of 14 employees in a rural environment. This fact of loss of employment seems not to be in consideration in this matter, and the effects on the communities and fiscus this will have.

The company is currently pursuing recourse through a litigation process in Port Elizabeth High Court, of 2 contracts that have been awarded improperly by 2 government departments (amounting to R 152m, in lost opportunity), with one department already having made a concession that the award process was improper, and one with the Department of Mineral Resources and Energy for a new Mining Permit non-decision (to expand our operation it is 2 years overdue).

It has come to a situation that, even though we have shown Standard Bank that we have work opportunities worth tens of millions. Someone with some power of handing over has resolved to hand us over and summons have been served.

What is mystifying is the fact that yesterday, i received an email from the lawyers that we have been handed over to and it refers:
"Dear Sirs
  1. We act on the instruction of Standard Bank.
  1. As you are aware legal action has been instituted against the abovementioned entity (and others) by our client in respect of various accounts held with the bank.
  1. In the above circumstances we are instructed to demand that you direct all further correspondence in relation to the accounts held with the bank, and the pending litigation, care of our offices.
  1. Our client has provided us with a copy of your correspondence dated 30 June 2022 requesting the settlement figures in respect of 4 (four) instalment sale agreements. The settlement figures are being obtained and will be delivered to you shortly by our offices.
  1. We trust you shall find the above in order.
