I was disappointed
Complaint about *******, ********* and irrational recruitment process.
I would like to lay a complaint about an unfair ************** against me. I have been discriminated on the basis of a medical condition.
I am Sikhumbuzo Hlophe (A247449),I have been on a learnership at standard Bank and I was working in the ***** department. The contract of the learnership ends 31/07/2023. This Friday I was advised that they are not going to convert me into a "permanent position" at standard bank and the reason for that is because since from February I am absent from work ,and it must also be noted that for each of these months I was absent only 1 day in each because I was struggling with flu which kept on affecting me now and then, however in June I was ****** and strangled in that process,such that the Doctor referred me to get an x ray for my neck and for all of the days I was absent I provided sicknotes. However,when I was fired on Friday all the sicknotes were taken into account, however they never meant anything to my manager as her actions imp**** that the sickness is deliberate and also overlooked the fact that I was absent for only about 4 or 5 days which is far less than the days I am entitled to
It is true that my contract was coming to an end,but the fact that some of my colleagues were hired and I was excluded despite the fact that I delivered excellent results than them from period starting January to may, and the fact that some of the people in that group were hired and me dismissed that did 'no longer amount to the end of contract but dismissal" as it created an expectation to those of us who are not hired as to why? Nomcebo overlooked all the statistics and fired me for ulterior motives as she also failed to explain to me and provide a logical explanation as to why I am fired,other than saying that "unfortunately this is the criteria she employed to exclude me",and she failed to explain the logic behind her criteria. She further stated that she can't work with people like me,I guess by that she meant people who are sick now and then. It must be noted that the reason for being dismissed on the grounds of being sick is far fetched and irrational and that amounted in me coming into a logical conclusion that I was fired for ulterior motives as the bank employees people not robots and it happens that people become sick, hence that is why the bank give people sick leave days
I have always been aware that I have been earmarked for dismissal I believe that her recruitment criteria was supposed to be informed by rational decisions such as looking into the statistics and in terms of how productive I was and despite the fact that I was delivering amazing work than any of my colleagues that was never taken into account as numbers don't lie.
Another thing Nomcebo mentioned is that those who were affected by system issues were not going to be dismissed on those basis as it is something beyond their control and she failed to apply the same logic in my situation as being sick is something beyond my control and what is interesting enough is that those who are normal late comers at work were never fired and I was fired for something beyond my control It must further be noted that on the 12 days I am entitled to for sick leaves,I have only used 4 or 5 and the greater 8 days remains unused,it was not like I used all these days and further exceed them such that I can be fired for this.
In terms of the constitution of the Republic of South Africa,any law/criteria that is contrary to the constitution such a law/rule/ criteria is invalid as the constitution states clearly that no one should be discriminated on the basis of being sick , The second reason for my dismissal is because she said my level of not authenticating customers is at 7% as compared to the 2% expected for the period taken into account January to may. This reasoning is also illogical to be fired on these basis as I was working in vacuum in terms of this,no weekly statistics were shared with us so i know how I am lacking in terms of this,the only weekly statistics that were brought were that of performance,for which I was a "Star" and I had no where to check my performance against in terms of authenticating customers Secondly if I was not authenticating customers in January or April it doesn't mean my level is sitting that high even now in July as I was given coaching at the end of the period for which it was taken into account and if I was lacking behind in terms of authenticating customers why was I not given coaching in January instead of being given in April ,the end of the period it was accounted for? The fact that I was given coaching at the end of such period, instead of being given earlier while I still had chance to improve indicates that I was setup for failure,she also failed to answer this, except saying that unfortunately this is a criteria she used, because even the issue of being sick was discussed with me now in July whilst this conspiracy of dismissing me was formed. On the basis of lack of rational thinking behind her decisions and inconsistencies that exist in applying this rules across different situations that are beyond an individual controls indicated that I was fired for ulterior motives. The bank should deal with the matter decisively as a failure by the bank will result in the matter being dealt with by parties outside of the bank.People should not be fired on the basis of such irrational **************.
