<p>Good day,</p> <p>I would like my R130+R130+R41.01 returned to me by Standard Bank (see attached breakdown of funds taken *******ly for no reason). My account was in credit of R61.01, Ucount rewards would have been R20 leaving me with R41.01. Standard bank must return my R41.01 and either reverse the "honouring fee" I randomly got charged of R260.00 or I will lay charges of theft against your bank.</p> <p>The same goes with the fact that I closed my Stanlib money market account on 2015 in Springs, and have been charged for this account still since then. Thank you finally responding after me having to first harrass and call Standard Bank.

As I told your call centre agent earlier, I have never ever had to make ’use’ of this honouring fee system. I only have ever used money in my account, which obviously no one looks at my credit history to note. As I also stated to your call-centre agent, I found the sms that proved to me that I had money in the account on the day of the purchases I made at pep stores for pyjamas and at Woolworths for soup (SEE ATTACHMENT). I even recall logging on to my profile via the application to check if there was any surplus funds, as I try cover all the debit orders and know the ridiculous fees some institutions charge. I have never know how utterly ridiculous the fees were with Standard Bank, As I stated that I have never ever had to pay your so-called "honouring fee".

As a person, I would like you to check up on my statements, even about logging on to my cellphone application (surely you have some people in the I.T. department who might be able to do this).

I'm telling you this before I go to the police station to lay charges of theft and *****, as there WERE fund in my account and if it wasn't such a hassle to change where my salary goes to I would've changed to FNB long ago as there are constant battles with your company and have had bad experiences (salary changes for the Department of Education requires myriads of forms and have many requirements).

Also, I expect proof in writing yet again that my Stanlib money market account was closed in 2015 before I further include that in the charges I feel I should lay against your company, because if I find time finally to sift through all my paperwork, I have the paper somewhere stating that it was closed. How many more hundreds (now thousands) will your company take bit by bit from clients and then find little loop-holes and technical jargon to get away from any blame?

When I bought online from Woolworths, I had money in my account, when I did the abovementioned purchases, I had funds... I have zero reason whatsoever!

I currently transferred R300 from my credit card just now purely to avoid a bad credit rating. This will also be placed on your social media, on hellopeter.com, and forwarded to every other e-mail contact I have for your company, as your call centre is always having "high call volumes" and one only gets a response if they have to harrass and annoy your company with a terrible attitude (out of pure shock at blatant outright theft, according to me).

Standard B ank has been prevented from deducting money from their customer's accounts to settle debts without their permission following last week’s High Court ruling in favour of the National Credit Regulator (NCR).


Nomsa Motshegare, NCR's chief executive, said yesterday (Monday) the ruling would result in consumers giving banks permission to transfer funds from savings accounts in order to honour credit debts.

“The NCR welcomes this judgment as it protects consumers from financial difficulties caused by the arbitrary transfer of funds from their accounts by banks”, said Motshegare.


Two years ago the NCR took Standard Bank to task for debiting accounts of customers without their permission based on a loophole in the application of the common law principle called set-off.

The NCR approached the court for a declaratory order to clarify whether Section 90 and 124 of the National Credit Act (NCA) rendered the common right of law set-off in was applicable in credit agreements.

The common law set-off principle permits the bank to debit money immediately from a client’s account as soon as there is money without authorisation and any amount the bank considers to be due to it.

“Banks should obtain permission from consumers before transferring funds from consumers’ accounts to pay amounts due under credit agreements”, Motshegare said.

Judge Raylene Keightley on Friday ruled that section 124 excludes the operation of the common law set-off in all credit agreements that are regulated by the NCA.

“While set-off provides a means by which the consumer/ debtor can avoid defaulting on her debt, there is no need why she should be excluded from the process. It seems to me to be precisely for this reason that section 124 preserves a system of set-off but requires the consent of the consumer before it can be affected,” said Keightley.

Standard Bank had opposed the NCR’s application arguing that if a credit agreement arguing that the set-off principle was important in the banking industry as it allowed it to recover the debt as soon as the creditor’s account was in its favour.

The South African Human Rights Commission was also a friend of the court in the case arguing that the set-off principle negatively impacted basic rights including socio-economic rights.

Cliff Johnson, the vice-chairman of the National Consumer Union (Sancu), which represents millions of consumers, said the ruling was very good news for consumers.

“It means that banks can no longer take money deposited into your account and use it to offset outstanding debt you might have on a credit agreement with the same bank, without your express permission," Johnson said.

I wish this would've happened ages ago, though...Standard Bank has ****** me blind up to 8k a month for 2 years for that stupid terrible flat and always only assisted it's "primary" bond-holder ******* my ex- but I paid...what a great day for consumers with Standard bank accounts!!????????
