Email 1:

From: Nerisha Letchman
Sent: 18 July 2016 04:32 PM
To: Nerosha Maseti; Standard Bank; info
Cc: Ricky Subjee; ********** Lee Shew, Yenlee Y; ********** /> Subject: RE: N Letchman / Standard Bank (NM/16/06-0374)

Nerosha many thanks for your email and the understanding in the first paragraph on what had occurred. But attached is receipt of the payment made which shows an invalid account which I went to the bank immediately after payment and was told by the Hydepark branch (which is 2 robots from my work so you can imagine how immediate this was) that it was an invalid account and would bounce back into my account. Which it did not and if I am a client of S/B the person who received these funds who is a S/B clients as well should be contactable (which according to the bank they cannot get hold of him – which by law is not correct) It is therefore ******* for the other S/B client to use funds without knowledge of where the funds have come from.

Has S/B tried to contact the client?

Why is S/B not furnishing me with the clients contact details?

Is it not ******* for a client of S/B to use funds that do not belong to them?

Is it not ******* for any company in this instance Standard Bank not to be able to get hold of client?

Attached is a payment receipt which shows payment went through to an invalid account? If a zero was added to make it a valid account it would have shown on the payment receipt

Payment Receipt

Beneficiary name:
R A Subjee

Bank name:
STANDARD BANK

Beneficiary account number:
********** 2

Branch code:
********** 1

Branch name:
ALL BRANCHES

My reference:
Ricky

Beneficiary reference:
Nerisha Thank you

Payment date:
2016-05-24

Amount:
R 2,000.00

I await your urgent reply as being the banking ombudsman I expected this to be resolved as I did not make an error. Your assistance in obtaining the clients contact details from Standard Bank would be appreciated.

Yours sincerely

Email 2: Response

From: Nerosha Maseti **********
Sent: Monday, July 18, 2016 15:24
To: Nerisha Letchman
Subject: N Letchman / Standard Bank (NM/16/06-0374)

OM B U D S M A N

FOR BANKING SERVICES

Summary of complaint

You did an EFT payment in the sum of R2000 on 24 May 2016 into account number: ********** 2. The payment was intended for account number: ********** 22, thus you omitted 1 digit of the account number. You are aggrieved by the fact that you inserted ********** 2 and not ********** 22, hence you are of the view that the money went into the incorrect account due the bank inserting an extra zero.

You want the bank to reimburse the sum of R2000.00.

Summary of the bank’s response

The bank’s response to the complaint is enclosed.

Assessment

You are aggrieved by the fact that Standard Bank inserted a zero in front of the account number that you entered. You are of the view that this caused the payment to go into a legitimate account, when in fact the payment should have been rejected. This understanding is incorrect. Essentially the amount went into the incorrect account due to you entering one digit short.

The funds went to the incorrect account due to you entering the incorrect account number. It was your duty to ensure that the account number that you intended to credit was correct. It appears that as you entered an account number that had one digit short. The account number field is pre-filled with zeros. The account number entered populates the field from the right hand side. If too few digits are entered, the zero/s to the left of the field remain/s in place. The field is therefore not “padded” to create an account number. Due to the different account number lengths used by the respective banks and account-number-for-life programs this is the only way in which the system can operate. It would be impractical to match the account number to the beneficiary’s name as this would require the user to enter the name exactly as it is recorded on the system in respect of spelling, spaces, case etc. In practice most transfers would fail due to the name not matching which would be counter-productive.

The banks do warn the users that they would not be responsible for wrong information provided by means of the terms and conditions link on the website.

The recall of funds where a customer has transferred funds to an incorrect account number was agreed upon by the Electronic Funds Transfer (EFT) rules committee and the EFT user business group. It was agreed that any reversal attempted must be authorised by the account holder of the funds prior to reversal. It was also agreed that if a portion of the funds had already been used then the recall request must be declined. In this instance, Standard Bank was unable to action the recall request as the full amount as the account holder was not co-operative. Hence the recall request was unsuccessful.

Our office could not conclude that there was any maladministration by the bank. Your claim is against the account holder who received the funds in error and not the bank.

We are prohibited in terms of privacy rights to divulge the beneficiary accountholder details. A prosecutor may however subpoena the information in terms of section 205 of the ******** Procedure Act from the bank. You can then proceed to claim the funds from the third party who unduly benefitted from the payment.

Conclusion

Our Assessment is based on the information available to us. There is regrettably no reasonable prospect of this office making a finding in your favor. Therefore, we have closed the file.

MY SITUATION WAS NOT TREATED AS A MATTER OF URGENCY. THIS IS MONTHS LATER. HOW DO YOU NOT HAVE CONTROLS TO PROTECT CLIENT'S INTERESTS IN THESE SITUATIONS??? IF I HAD WAITED THE WHOLE DAY TO COME TO YOU THEN I WOULD MAYBE UNDERSTAND THE FUNDS HAVING BEEN USED. THE FACT THAT I CAME IMMEDIATELY YOU SHOULD HAVE GRANTED ME THE COURTESY OF ATLEAST TRYING TO REVERSE THE TRANSACTION! SO MUCH I TAKE FROM YOU AS A BANK BUT THE WAY YOU HAVE SHOWN THAT I AM REALLY NOTHING BUT A USELESS NUMBER IN YOUR BOOKS IN THE MOST INCONSIDERATE OF WAYS HAS GOTTEN ME TO THE DECISION OF SWITCHING TO FNB. ALL OF MY INTERESTS AND MY FAMILY'S INTERESTS. NEXT TIME IT WON'T BE R2000, IT WILL BE MY WHOLE SALARY DEPOSITED BY MISTAKE, THEN WHAT? I AM GOING TO A BANK THAT WILL RESPECT AND PROTECT MY HARD EARNED MONEY. IF YOU CAN'T GIVE ME THAT, WHY WASTE MY TIME WITH YOU! R2000!!!!! THAT'S MY HARD EARNED MONEY WHICH I NOW HAVE TO PATCH IN SOME OTHER WAY. HOW IN THESE HARD MARKET CONDITIONS I DO NOT KNOW. BUT ATLEAST WE KNOW YOU DON'T GIVE A ****! CHANGE YOUR SYSTEMS BECAUSE RIGHT NOW IT HAS JUST LOST ME MONEY I DON'T HAVE!!!! MY PAYMENT RECIEPT SHOWS THE INVALID ACC NUMBER I ENTERED WHICH IS CORRECT AND THEREFORE SHOULD'VE READ "INVALID ACC NO AND REJECTED", SO WHEN AND HOW DID YOU ADD AN EXTRA ZERO FOR IT TO LAND UP IN A WRONG ACCOUNT? NEVER HAVE I SEEN THIS IN MY ENTIRE LIFE! THIS IS *****!!!
