Exploitation of Consumer

During the course of December, I received an email stating I must contact MBD to make payment arrangements on my Standard Bank account.

I already have payment arrangements in place with Standard Bank, such arrangements were made at the Rand Ridge Mall branch.

Cecilia can attest to this - and confirm that I have made every payment, on time and in full as per the agreed repayment amount.

I am now in a position where MBD call centre agent contacted me and advised that I have not paid since December 2016. And that MBD bought over the account.

The initial email received from MBD appeared **********, hence I contacted you, Cecilia, to clarify - which you said you would do - I have not heard back from you.

I continued to make payments to Standard Bank directly, as these were in line with the agreed repayment arrangements and in good faith.

When I reverted to the original MBD email, and a few subsequent emails asking me to contact them, I received no reply - to me, an email asking to phone MBD re my Standard Bank account is a cheap 'please call me' and appeared ********** - no one who has payment arrangements in place, makes payment and queries this email with Standard Bank (as well as reverted by email to MBD on receipt), would reasonably make payment to MBD for no apparent reason.

Take note, I have cc'd the banking Ombudsman. I have also cc'd the NCR complaints division.

I will be lodging a complaint on HelloPeter against Standard Bank, as well as against MBD.

The behavior shown is ******* and *********. Note that Standard Bank of South Africa entered into a NEW agreement when the payment arrangements were made and accepted.

The following outcome is demanded:

1 - Acknowledgement that the account was sold to MBD, albeit not in good faith

2 - Confirmation of the withdrawal of the account from MDB, and re-assigned to SBSA

3 - Confirmation of receipt of payments made to SBSA, and an updated statement of account

4 - complete restoration of my credit profile with the relevant credit bureaus - and written confirmation thereof (as required under the provisions of the NCA)

5 - A letter of apology from both Standard Bank and MBD for the inconvenience caused, as well as the ********* behavior shown

I further state the following:

I will NOT accept phone calls from MBD Call Centre

I will accept phone calls from Standard Bank

I will accept phone calls from MBD Directors/Partners or most senior legal counsel

Any harassment experienced will result in further legal action against the party not adhering to this email.

The exploitation of consumers is an ongoing practice by banks, and I will not tolerate it. The situation has presented itself, and can be dealt with reasonably and professionally. This will be in accordance with what I have outlined above.

The wrong consumer has been exploited today, and I will not tolerate it.

(PS supporting documents available to confirm and reiterate the statements made in this mail)

With kind regards
