Breech of agreement and double standards
<p>In 2008 I had an existing cheque account with an overdraft, I also took a revolving credit loan for my then ex-wife on my name. I was paying this loan on behalf of my ex-wife who was eventually going to take over. In 2009 i went through a nasty divorce and was left with my kids as well as all the debt incurred as everything was on my name. I was in financial turmoil and could not afford the required instalments on my Standard Bank credit card, cheque account overdraft and revolving loan as these accounts fell into arrears as a result. In 2010 my divorce attorney contacted standard bank and acknowledged my debt on my behalf and informed them that i will make affordable payments to each account: cheque-R200 pm, RCL R800 pm and credit card R200 pm three different standard bank accounts with seperate reference numbers were provided by standard bank collections departement. The aggrement was reached in 2011 for the RCL and credit card and in 2012 for the cheque overdraft with the accounts being written off and a total figure on each account given with no additional interest being charged per month. I have been paying these accounts religiously every last working day of the month since. I have since payed off the credit card in 2014. In 2016 I contacted standard bank collections departement to request for statements on both the existing accounts to establish the balanances, i was told that these accounts were being handled by different attorneys namely: RL Daly for the RCL account and Stupel and Berman for the cheque. On 2016-04-18 at 10:50 i was assisted by Nelly Dlamini at standard bank Phoenix Plaza branch who called both attorneys on my behalf to request detailed statements. Nelly spoke to Nazreena at RL Daly and obtained a balance of R5765 on the RCL account with a detailed statement to be emailed, she also spoke to Molly Hau at Stupel Berman and obtained a balance of R11277.31. i continued paying these accounts. On 2016-09-06 at 08:23 I recived a call on my cellphone from a lady stating she was from Norman Bissett and Associates informing me that my accounts are in arrears and i have been handed over to them for collection. I informed the lady that I have been paying these accounts every month and have proof of this and was dealing with other attorneys as well as standard bank collections departement, the lady the said she cannot assist me and that i should make payment arrangements with them. I have been to standard bank phoenix plaza at least five times since and was assisted by Nelly Dlamini, she emailed my bank statements as proof of payments to NBA as they stated that they recieved my accounts in june 2016 yet i was never informed of this by standard bank or the previous attorneys. I have been keeping records of my payments and balances and the amounts that i have recieved for NBA attorneys as balances are totally off, I have tried several times to sort this matter to no success. I have asked standard bank collections to provide me with a reason as to why I was handed over to another attorney without being notified yet i never faulted in my payment arrangements since its inception with no conclusive answers to date! I have been put through a lot on inconvenience and stress as a result of this issue and cannot understand what kind of practise this is from one of the biggest banking institutions in SA. This is totally absurd!</p>
