Sneaker defect dilemma
<p>Good day</p> <p>Kindly please assist with the following issue i have with Spitz from Rosebank</p> <p>I bought a white sneaker last year in October towards month end but i then discovered that the leather was detaching from the shoe and i called spitz Mall of Africa and was told that i have 6 months without the date of purchase to return the shoe if it has defects then i decided to go Spitz Rosebank since i bought it there. <br />I was then given attitude when i arrived because i was asking a lot of questions and i just wanted to understand, was assisted by Kagiso and Boniswa.<br />They took a picture saying they will forward it to the Regional Manager Tanya Glaser and revert back with feedback.<br />Kagiso called me back and told me that Tanya said i was suppose to return the shoe within 30 days as per the slip. Kagiso refused to give me the details of Tanya so that i can speak to her myself as he was just the middle man.</p> <p>Then i went to the Consumer Protection Act and this is what i found: ) RIGHT TO FAIR VALUE, GOOD QUALITY AND SAFETY<br />a) Right to demand quality service<br />Consumers are entitled to the following when entering into an agreement with a supplier<br />Timely performance and completion of service<br />Notice of any unavoidable delays in the completion of the service<br />High quality of workmanship and service<br />Use and installation of goods, free of defects and good quality<br />Suppliers must remedy and defects in quality or services or refund the consumer a reasonable amount of the price of the service or goods.<br />b) Right to safe, good quality goods<br />Consumers are entitled to products in good quality and safe working condition and free of defects.<br />Products must comply with the standards ACT NO 29 of 1993 or any other ACT REGULATIONS.<br />c) Right to imp**** warranty of quality<br />The producer, importer, distributor and supplier must warrant that the goods comply with requirements of being of good quality, durable and safe for the use as advertised or designed.<br />If goods are of inferior quality, unsafe or defective the consumer may return the product within a period of six months at the expense of the supplier.<br />Suppliers are obliged to repair, refund or replace the failed, defective or unsafe products.<br />Please kindly assist with this situation.</p> <p>Regards<br />Keitumetse</p>

Thank you for your feedback and informing us of your concerns relating to a pair of sneakers purchased in October last year.
Assessment of these shoes confirmed no evidence of a factory fault.
While scratches were noted on the sneakers these are a result of wear and not of any manufacturing defect.
Since these shoes have been worn over the past several months we are clearly not able to accept them as a return.
Please note that our T's & C's cover a return of merchandise within 30 days of purchase providing items are returned in their original packaging, unworn and with the original till slip.
Where an assessment reveals a manufacturing defect shoes may be returned within six months together with the proof of purchase date.
In this particular instance the returned shoes have been worn and do not present with any manufacturing defect.

Scratches and opening up on the front and by the way its not serval months it is 5 months to be exact and during that 5 months i wore that shoe maybe 5 times and not more than 10 times and for a shoe that costed me R1500, this is very disappointing indeed.
Please elaborate on what is factory default and also explain the 6 months rule as writtten on the consumer protection Act.
i have never washed that show because i dont wear it often because i have a whole lot of other sneakers.
i will not take this lightly because the shoe didnt cost me 500 and i was not abusing the shoe because my intention was never to return the shoe.
