unfair contract

Good Day everyone, so last year August 2019 I enrolled my sister at one of the Spark School (Ferndale in Randburg) for the academic year 2020. To secure a space for her at the school, I had to pay upfront fees for January 2020 amounting to R2550 and an administrative fee of R500, which I did pay in August still 2019. Towards the end of 2019 we decided that it will be in the best interest of the child not come and school in Johannesburg in 2020 due to health reasons; I therefore emailed the school on the 27th of December 2020 to terminate the enrollment contract I had signed in August 2019 for 2020 academic year. they responded to me in January 2020 with a termination contract which I signed the same day and sent it back to them, now I was well aware that they will not be refunding me the January fees I had already paid in August 2019. Last night on the 26th of February I got a shock of my life when I saw a debit order form Spark schools for February 2020 school fees, I called them this morning to enquire and they told me that the enrollment contract I signed stipulates that "should I want to terminate the contract, I will then then have to give the school a three months’ notice and also liable to pay fees in those three months".

So now I will be paying for the next two months R2550 of fees for a child who never entered their premises, a ghost child basically! jho the agreements we sign have a way of getting back at us to bite us :-( because life happens
