SEEFF CALVINA AND SWELLENDAM

I bought a stand without a Seeff Calvinia agent being involved. The seller had sole mandate of which we did not know. I said I am not liable for commission as I NEVER knew about the agent. The seller then did not want to sign if she had to pay the commission. The agent had to hold the seller liable for the commission as SHE did not keep to the contract. We went to Seeff Swellendam and Barbara told us that we do not pay the commission. The commission was added onto the stand and I kept on explaining this over and over. I was overjoyed when told we do not pay the commission, but the seller does as she signed the sole mandate. I signed the contract which DID state the amount with the commission, but Barbara told me and my husband we do not pay the commission. We are now paying R12000.00 commission as the price the seller told me was R140 000.00 and I pay now R152000.00 plus the transfer costs on the escalated amount. I did phone Barbara's office as soon as the attorney stipulated out to me that I HAVE to pay the R12000.00 extra and left 2 messages of which she did not even return one. I bought the property for R140 000.00 from the seller and now an agent Flip Augustyn comes and I have to pay an additional R12000.00. IF i KNEW the property was listed with ANY agents, I would have made arrangements to meet with the agent in November 2020. I paid R25000.00 on 28 November and R15000.00 in January. Still NO mention from the seller of ANY agent until I confronted her in March 2021 as I say the property was listed on internet and I have already paid R40 000.00 over to her. I want this property and I feel the agents let me down. With R12000.00 I can buy approximately 1000 bricks and the agents have to take responsibility for "failing to understand" my situation!!!!
