Disappointed by SEEFF Property Group

I immigrated to the Netherlands and asked SEEFF properties to market my apartment. They found a buyer and signed a contract in July 2020. However, the buyer has only paid half the purchase price to date and it has been 6 months since the contract was signed.

I decided to ask threeprecent.com to also market the property since I still have to pay the levy and municipal taxes every month. Furthermore, the buyer continues to make excuses why she cannot pay the outstanding amount. Threepercent properties came back with the following reply:

"My assistant contacted SEEFF yesterday to make arrangements to get a copy of the key made. SEEFF made it very clear that should we sell the unit we are opening you, the seller, to double commission. I am not sure why she said that because we won’t be taking an offer from their existing buyer.

What concerns me is that on the copy of the SEEFF OTP I have they failed to but and expiry date in clause 4.2 by which the purchaser should have finance by. This is open ended and works in the purchaser’s favour. I could be mistaken but perhaps it is not a bad idea to get your lawyer to go through it."

This is the answer I get after SEEFF told me that the sales process will be finalized within a period of 3 months. SEEFF were never honest with me when they sold the property and since they have already received their commission from the attorneys they don't really care anymore.

I entrusted SEEFF with the sale of my property since I thought they are one of the best property groups in South Africa. However, I made a big mistake and I now regret every day that I did not handed the sale of the property to threepercent.com. SEEFF also told me 2 weeks ago that the buyer has been put in mora, but on Thursday, 17 December the attorneys contacted me and indicated that they cannot place the purchaser in mora without receiving a written request from me. The purchaser has finally been placed mora after several complaints and follow up emails enquiring about the sale of the property.

I can highly recommend threepercent.com! Their client service is excellent and they returned my emails as well as reviewed the SEEFF contract without charging any fees. I am now more informed about the sales contract of my property drawn up by the attorneys of SEEFF after my consultation with threepercent properties. Also note that threepercent properties only takes 3% commission!
