Sanral and Instatoll Quagga Phelindaba failure to do road maintenance that resulted in an Accident

On the 28 April 2023 i was driving my BMW 3 series along the N4 highway towards North West province, just before Phelindaba toll plaza when i noticed that the was a dead dog on the road-fast lane. I tried to avoid it by swinging to the left line but there was a ford double cab driving behind me that prevented me from changing line. Unfortunately, i collided with that dead dog and my bumper spoiler was totally broken, and arm control damaged.

I immediately informed the toll plaza officials about the incident, which to my surprise they informed me that they knew about a dead dog but unfortunately they couldn't remove it as their patrolling car had engine breakdown and out of service for two weeks. They informed me that they reported the incident to Instatoll and Sanral management but they didn't get response and resources to do patrol maintenance and removal of debris and aliens objects on that N4 road.

I was referred to the Toll manager who was on site and he confirmed that they are not doing road maintenance because they dont have a car. I was advised to get three quotations and police case, affidavit and pictures of the accident. I submitted all those documents to the toll manager who informed me they have submitted to their insurance and head office.

However, after two weeks i received an email that was badly written by one Instatoll officials saying they cant be held responsible for the incident because their roads infrastructure does not have fence to prevent stray dog from coming on the road. Despite the fact that my claim was not based on the stray dog crossing the road but the already dead dog that was supposed to be removed after accident but was not removed because the Toll plaza didn't have maintenance vehicle. They declined my claims without providing reasonable reasons or responding to why they failed to provide maintenance vehicle to the toll management that would have prevented the incident in first place. My vehicle damage sits at R 24 000,00.

Can anyone help me as i dnt know hoe to proceed with Sanral.
