Somebody smashed my car whilst I was worked Ng through negligent driving in a parking lot, long story short...their insurance accepted full liability, my insurance now requires me to fork out over R20 780 as excess, to have my vehicle repaired, I have 3 months to come up with the money, they claim that they can only proceed with repairs, once I have paid the excess, which they will then cla back from the other party, and then I will get reimbursed...my excess, what about my inconvenience being suffered right now...a brand new car I only had for two days, who says my car will be repaired and be as new as when I bought it, why must the financial burden of the huge excess now be my problem...when they have lawyers who can deal with this between insurance companies

We acknowledge receipt of your message and are sorry that you are unhappy with the terms your policy.
 
Whilst the circumstances of the loss are unfortunate, we confirm that the vehicle will be repaired by authorized repairer so as not to affect your factory warranty. 

We confirm that you accepted the policy directly with your Broker. We have listened to the recording of the conversation between yourself and your broker and can confirm the following: 
  • The basic excess and all of the additional excesses were disclosed and explained in detail.
  • These excesses were agreed to and accepted by yourself.  
 
We refer you to your policy contract , page 22, Section I
I. WHAT YOU HAVE TO PAY WHEN YOU CLAIM
1. Every time you have a valid claim, even if it is not your fault, you must pay the basic excess, the voluntary excess(if applicable), as well as any applicable additional excesses as noted on your Policy Schedule or any other applicable deduction. Make sure you are fami**** with these additional excesses.
2. If you are in a motor vehicle accident that was not entirely your fault, we try to get back your excess from the other party, and we repay you a pro rata share of any amount recovered. We do not guarantee that we will recover any excess.
 
Considering the above, the Insurer does not guarantee the recovery of your excess nor is the Insurer obligated to institute any recovery process.
The Insurer can only consider legal action against the 3rd party after your claim is processed and you make payment of the excess for which you are contractually liable.
Further to this, We are not in a position to waive or reduce any of the applicable excesses. 

An Excess is an undertaking that the Insured(ie. Yourself) will be responsible for a certain amount of their loss in respect of every claim. It is the portion of the claim that the Insured agrees and accepts as the amount they must pay for any valid claim. 
We confirm that the policy terms & conditions have been correctly app****. Unfortunately you cannot dispute an excess that you, yourself have chosen & accepted.
