DISHONOURED CLAIM

My name is Nozinja Jilimba a memeber of SA Underwriters Agencies with ID number: ***, policy number: SAU***. On 06 February 2022 my vehicle was damaged and after that I contacted SA Underwriters Agencies to lodge a claim (Claim number: CLM***). After that I was asked by one of the consultants to send through the pictures of the damaged vehicle together with a quotation from the panelbeater so that SA Underwriters Agencies can take care of the payment. The panelbeater did fix the vehicle but to my surprise, SA Underwriters Agencies failed to pay the panelbeater as promised. A lot of emails, WhatsApp messages and telephone calls were directed to SA Underwriters Agencies to followup on the payment of the panelbeater of which they failed to initiate. To my surprise, around 04 August 2022 I received a correspondence from SA Underwriters Agencies that I have the claim as the vehicle has been fixed of which I don't understand why will I cancel the claim while I have an outstanding debt with the panelbeater which must be paid by SA Underwriters Agencies. To date, the debt is stil outstanding and no claim payment was made to the panelbeater whatsoever. I have never said to SA Underwriters Agencies that I want to cancel the claim. SA Underwriters Agencies should do what I pay them for, and pay the claim or else I am taking up the matter further with the Ombudsman and after that cancel my policy with this company. I trust that you find this in order and await to hear from you as urgently as possible.

Thank you for bringing the below to our attention. 

We have investigated the matter and can now provide the following feedback. 

We would like to make reference to your policy contract page 23, Section G, point 7 
G. IMPORTANT: YOUR RESPONSIBILITIES 
In order to have ongoing cover and a valid claim, you agree to always:
7. ask for our permission before doing any repairs, or else your claim may be rejected;
 
We confirm that you undertook to conduct your own repairs with an unregistered panel beater without the consent of the Insurer.
 
In doing so, you have denied the Insurer an opportunity to properly validate the claim. 
In terms of your policy contract the Insurer has no obligation to settle your claim because you have breached the policy contract. 
 
Notwithstanding the above we confirm that the Insurer has contacted you to discuss the matter and considering your history with the Insurer we have come to an agreement
