Last year Oct while driving on the R59 a piece of glass fell from a mcoys truck onto my bmw, cracked windscreen chipped paint and light. Phoned my insuarce and my car went in for repairs in January. After my car stood at panelbeaters more then a month I paid the excess via creditcard as I needed my car. problem is each month I pay my installment on insurance but dont get service from them. Their legaldepartment sued hollard(mcoys insurance) for the entire ammount including my excess but I havent recieved my excess ammount back, the only people who has bennefited is sa underwriters. why should I have payed excess if accedent wasnt my fault. I want my money back but they arent doing anything about this. This case has been open for 7 months.
Firstly it must be noted that a recovery is not guaranteed. The success of the recovery is influenced by numerous factors, such as successfully tracing the third party, whether that party is insured or not, the third party's willingness to co-operate with the insurer and numerous other factors. The recovery process is therefore lengthy and uncertain. It must be noted that the insurer does take every step necessary and viable in pursuit of the recovery, including litigation. This does not then prevent the Insured, if satisfied that the accident was due to the other party's negligence, and he or she is prepared to take the risk, from suing the third party for the recovery of the amount of his or her excess, with the agreement of the Insurer. What you are not entitled to do is to compel the insurer to try to recover that loss. So, in summary, and generally speaking, your Insurer is not doing anything wrong or ********* in not acting so as to try to recover your excess for you, but if it does not itself take action, then there is absolutely nothing to stop you from trying to recover it yourself.
