Khusela Insurance (SATAXI) 3rd party claim insufficient funds

To all fellow road users

A taxi drove in to me 2 November 2018,he overtook several cars traveling in a incoming lane according to a pedestrian crossing traffic official before he drove in to me.

He nearly rolled the taxi loaded with passengers after he knocked in to my right front fender and wheel,only to be brought to a stand still by a vibacrete wall about 100 meters away from point of impact.

According to the AR and traffic officials on the scene at the time,the driver had no license or pdp.I had to wait over 2 hours for the owner of the taxi to arrive on the scene for what i do not know.During the whole event no police officials were on the scene although they were stationed less then 2 min away.The owner then went to the police station to file his accident report as i would assume that the traffic officails would not provide him with an AR that will count in his favour for insurance purposes.

I had to beg and plea for over 2 months with the owner for a claim number which i finally received,now i was requested to get 2 quotes and all valid documents of the car including the service log book which i do have indicating a FSH to date and send it off with a third party claim form etc.Another month and a half went by meaning my claim was being validated meaning my claim was being investigated(Checking both claims and AR).After several unanswered phone calls and emails i finally got a reply stating an assesor would have to meet up with me to check if the quotes are what is required to get my car restored to it former accident free and smooth driveable condition.

Finally another month went by before a settlement offer came through meaning my claim is valid but also indicating that i was also in the wrong for not checking if there was any taxis traveling in the same direction but in a incoming lane.This was their excuse for not wanting to settle the quoted amount of R57K damages to my vehicle.

Now we all know,by my front right wheel being knocked in a right turn position that my suspension took a heavy bump where my lower control arm,complete strut,rim and knuckle was damaged including my R/F fender,headlight and bumper with grills that were ********** their clips and *****s.

Now the settlement offer came to less then R22K (38% of the total amount)where the knuckle alone cost R15K according to the quotes.My car is not brand new but it was accident free and operating without any problems,how am i suppose to have the car restored with the amount they are offering(impossible).I am certainly not taking it to a backyard panelbeater that will end up costing me more to have the vehicle repaired.Therefore i rejected the offer where i got a reply stating that it is none negotiable and according to previous cases i contributed to the accident taking place.I simply rep**** that "looks like your firm has been challenged before maybe i should seek legal advise on this,also what will happen if they find out that your clients vehicle has been restored and fixed knowing that the driver had no papers or license".After a long pause i received another mail stating"thank you for the information we will have to investigate self damaged claim and that a third party claim will not be entertained if the claim was **********.

Now please tell me this,how did it come to me getting a settlement offer with them doing a validation of the claim and then upon my rejection of the offer then wanting to do another investigation of self damage liability.I have pointed it out on previous emails(before the offer) that the driver had no license and pdp according to my AR and that the validation should not have to take this long as our livelihood depends on it and that job offers had to be declined as my vehicle was not in a presentable condition for the job.

This review can go on for a while.

What i need to know is where do i go to besides having to turn this in to a civil case which can take for ever and to have this matter resolved with a fair settlement offer.
