Rawson Roslyn is disorganized and takes advantage of people they think cannot fight them

<p>I bought a property last year through Rawson – Roslyn Branch in Brackenfell Cape town. Due to the seller’s financial difficulties, it took more than a year for the property to be transferred to my name. When the unit eventually transferred on the 23rd of August 2016, Rawson sent me a congratulatory email but nothing was said about getting keys to the property. We tried contacting the Sales Agent but we couldn’t get hold of him. Out of desperation we visited the property and found the tenants of the previous owner still happily leaving in the flat. This is not what we wanted. When I signed the offer to purchase we were very clear that the unit must be vacant on transfer. We insisted on this clause for a reason.</p> <p> </p> <p>These tenants informed us that their Letting Agent (who works for Rawson Roslyn branch too) said they have nothing to worry about because the new owner is not planning to move into the property. This is in breach of our contract. Our contract clearly stated that the property should be vacant.</p> <p>When we eventually got hold of Rawson (5 days after the transfer), they informed us that the reason they didn’t give the tenant notice is that they didn’t know that the property has transferred. But I have proof that they knew about the transfer at least 5 days ago and did nothing to mitigate the situation.</p> <p> </p> <p>Another thing, our Offer to Purchase had an Occupational Rent clause too. We asked them to transfer the Occupational Rent for August and September. Their response was, August 2016 rent was paid to the Transferring attorneys hence we must call them. We called the Transferring Attorneys. They didn’t know anything about rent. We went back to Rawson and we were ignored. On the 22nd of September I received an email from Rawson saying the rent was actually paid to the Body Corporate’s lawyers, hence we must contact them. How are we going to contact them and ask for money that Rawson paid to them? The money has already been credited against the levy account of the previous owner. I explained this to Lee-ann. Now they are not responding to my emails.</p> <p> </p> <p>I’ve now received September rent from the tenants directly. But August 2016 is still not paid to us.</p> <p> </p> <p>Rawson agents are arrogant and lazy. We want our money back. We are not going to be the ones to pay for your lack of forward planning.</p>
